DMCA Takedown Policy

Introduction

This Digital Millennium Copyright Act (DMCA) Takedown Policy is effective as of March 7, 2025, and applies to all content published on PressClone (pressclone.com).

PressClone respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we have established the following policy to address claims of copyright infringement on our website.

If you believe that your copyrighted work has been copied and is accessible on PressClone in a way that constitutes copyright infringement, please provide our designated copyright agent with the following information:

  1. Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  3. Identification of Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit PressClone to locate the material.
  4. Contact Information: Information reasonably sufficient to permit PressClone to contact the complaining party, such as an address, telephone number, and, if available, an email address.
  5. Good Faith Statement: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy Statement and Perjury Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

How to Submit a DMCA Takedown Notice

DMCA takedown notices should be submitted to our designated copyright agent via email at:

Please include “DMCA Takedown Notice” in the subject line of your email.

Upon Receipt of a Valid DMCA Notice

Upon receipt of a valid DMCA takedown notice, PressClone will:

  1. Remove or disable access to the content claimed to be infringing;
  2. Notify the content provider, member, or user that we have removed or disabled access to the content;
  3. Provide the content provider, member, or user with a copy of the takedown notice;
  4. Provide the content provider, member, or user with information about how to file a counter-notice.

Counter-Notification Procedure

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated agent containing the following information:

  1. Physical or Electronic Signature: Your physical or electronic signature.
  2. Identification of Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  3. Statement Under Perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Name, Address, Phone Number: Your name, address, and telephone number.
  5. Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which PressClone may be found.
  6. Acceptance of Service: A statement that you will accept service of process from the person who provided notification of the alleged infringement.

Please include “DMCA Counter-Notice” in the subject line of your email.

Upon Receipt of a Valid Counter-Notice

Upon receipt of a valid counter-notice, PressClone will:

  1. Provide the complaining party with a copy of the counter-notice;
  2. Inform the complaining party that we will replace the removed material or cease disabling access to it within 10-14 business days;
  3. Replace the removed material or cease disabling access to it within 10-14 business days following receipt of the counter-notice, unless our designated agent first receives notice from the complaining party that an action has been filed seeking a court order to restrain the allegedly infringing activity.

Repeat Infringer Policy

PressClone maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. A repeat infringer is a user who has been notified of infringing activity more than twice and/or has had content removed from the service more than twice.

Modification of Material or Activity

If you are the content provider and you believe that your content is not infringing, or you have authorization from the copyright holder, the copyright holder’s agent, or pursuant to the law, you may send a counter-notice containing the information above. When we receive a counter-notice, we may, in our discretion, reinstate the material in 10-14 business days or more after we receive the counter-notice, unless we receive notice that a legal action has been filed against the user.

Good Faith Belief

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability.
